1. Acceptance of Terms

By accessing, browsing, or using the FetishPartner website located at fetishpartner.org (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). To the fullest extent permitted by applicable law, in no event shall FetishPartner, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Any conduct or content of any third party on the Platform.
• Any content obtained from the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total cumulative liability to you for all claims arising from or related to the Platform shall not exceed the amount you have paid to FetishPartner in the last twelve (12) months, or one hundred euros (€100), whichever is greater.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FETISHPARTNER DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Platform or the server that makes it available are free of viruses or other harmful components. You assume all risk associated with your use of the Platform.

7. Termination

We may suspend or terminate your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion tools within the Platform. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Platform shall be instituted exclusively in the courts located in England and Wales.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
